摘要
十八届四中全会将党内法规体系和法律规范体系涵括于中国特色社会主义法治体系,提出"注重党内法规同国家法律的衔接和协调"的命题,需要我们首先跳脱"国家法中心主义"和传统党建理论的思维定势,立足法治一般规律和中国政治现实,从国家治理现代化的高度认识二者及其相互关系。党内法规是管党治党建设党的基本依据和党内治理法治化的制度载体,国家法律是由国家强制力保证实施的具有普遍约束力的行为规则,二者存在显著区别,但都是党的主张和人民意志的统一,都是治国理政的规范依据,需要遵循国家法律高于党内法规、党内法规严于国家法律的原则处理二者关系。党内法规与国家法律衔接和协调是依法执政的现实要求,需要妥善解决二者间不协调、不衔接和不一致等问题。
The Fourth Plenary Session of the Eighteenth CPC Central Committee incorporates the Party＇s rules and regulations into the socialist rule of law system with Chinese characteristics, and puts forward the topic of ＂paying attention to linking and coordinating the Party＇s rules and regulations＂, which requires people to avoid the fixed mindset of ＂national law- centeredness＂ and the traditional Party building theor）; be based on the general principle of rule of law and the Chinese political realit）; and understand them and their relationship from the perspective of modernization of national governance. Inner-Party regulations are the basis for governing, managing and building the Party as well as the institutional carrier for making the intra-party governance law-based, while national laws are code of conduct with general binding force and are enforced by the coercive force of state, significant differences exist between them, yet both are the unity of the Party＇s views and the people＇s will, and also the ground for standardizing the national governance. So we need to follow the principle of putting national laws in a higher position than the regulations of the Part）; and ensuring that the Party regulations are stricter than national laws when dealing with their relationship. The linking and coordination of the Party＇s regulations and the state laws is the realistic requirement for government administration according to the law, so there is the need to solve the problems of any incoordination, incongruence and inconsistency between them.
