摘要
作为一种重要的跨学科研究方法,大数据研究方法在法学中已有广泛应用。然而,通过考察大数据研究方法在刑事法学中的应用,不难发现其也存在明显的局限性:不适用于难以量化的对象;不能代替定性研究;相当多的数据、合适的样本不易获取;容易忽视细节和联系以致基础不够坚实;存在逻辑断裂,结论仅是或然性的;貌似具有宏观视野却不及类型化思维。因此,大数据研究方法的作用不能夸大,更不能形成"大数据崇拜"。
As an important interdisciplinary research method, the big data research method has been widely used in the law science. However, it is easy to find obvious limitations via examining the big data research methods in the criminal law research. It is improper to apply it to objects which are difficult to quantify. It is not a substitute for qualitative research. It is also difficult to obtain quite a lot of data or suitable samples. It is easy to overlook the details or connection so that its foundation is not solid enough, and there is a logical problem, and its conclusion is probable. On the surface it seems to have a macroscopic vision-scope but in fact it is inferior to the category thinking methods. Thus the role of big data research methods cannot be overstated, nor be worshiped.
