摘要
合同效力纠纷在诉讼中表现为撤销权案件。尽管实体法对合同效力的类型及产生原因进行了明确规定,但由于在诉讼中当事人对自身主观心理状态的证明存在一定的难度,进而难以有效维护自身的合法权益。为此,针对这类案件的自身特点设计以间接证据、推定和适度降低证明标准相结合的证明规则,是处理此类纠纷的程序性方法之所在。
The litigation performance of the dispute of contract validity is the right of revocation case. Despite the substantive law regulations on the types and reasons of contract validity, there are some difficulties on the evidence of the parties＇ own subjective state of mind. It is difficult to effectively safeguard their legitimate rights. To this end, in the view of the characteristics of this kind of case design, the combination of indirect evidence, presumption and appropriate reduction of the proof standard is the procedural approach to dealing with such disputes.
