摘要
网络游戏直播作为新兴产业,其涉及到的著作权问题在目前的司法实践和理论研究中都存在模糊不清的问题。网络游戏直播行为涉及到网络游戏著作权人、游戏玩家、主播和网络游戏平台等不同主体的专有权利。在我国现行著作权法框架下,这种专有权利并不落入广播权和信息网络传播权的控制范围,只能寻求兜底条款的保护。网络游戏直播行为是否构成合理使用,需要根据不同的游戏类型具体个案判断,玩家个人直播符合三步检验法,构成合理使用,而大型竞技类游戏的直播无法通过第一步检验,部分非竞技类游戏无法通过第三步检验,均不构成合理使用。
As a new industry, the online game live broadcast has controversies over the copyright both in the current judicial practice and theoretical research. The online game live broadcast involves the exclusive rights of different subjects, such as copyright owner, game player, anchor and online game platform of network game and so on. In the current framework of copyright law, this exclusive right does not fall into the scope of broadcasting right and information network communication right, and can only seek the protection of the clauses. It is necessary to judge according to the specific game types whether the online game live broadcast is fair use. Personal live is fair use since it meets the three criteria. The large -scale competitive games cannot get through the first criterion, and a part of the non - competitive games cannot pass the third criterion, both of which are not fair use.
