摘要
《深圳经济特区医疗条例》作为国内首部地方性医疗基本法规,是深圳充分运用特区立法权,通过立法解决医疗法律法规滞后问题,在全国率先把医改纳入到法治化轨道,为深圳医改挺进"深水区"提供法律保障和支持。在医疗监督方面,《条例》对记分衔接处罚、虚假诊断等都进行了调整,有利于于促进医疗机构规范执业。该研究结合自身实践,对适用《条例》在医疗卫生行政处罚方面的问题进行浅析。
The shenzhen special economic zone medical regulations, as the first local medical basic laws at home, can solve the delayed problems of medical laws and regulations by fully using the legislative power of the special zone and provide legal guarantee and support for medical reform in Shenzhen to push forwards the deep water by taking the lead to put the medical reform into the track of legal system, in the medical supervision, the regulations adjust the punishment and false diagnosis, which is conducive to promoting the standardized practice of medical institutions, and the paper analyzes the problems of regulations in the medical health administration.
