摘要
检察机关内设机构系检察权运行的组织载体,属于检察组织的重要内容,是此次《人民检察院组织法》修改的重点。文章从当前检察机关内设机构现状入手,分析了内设机构设置在标准、名称、数量及派出机构等方面存在的问题、成因及影响,进而提出了检察机关内设机构设置应当遵循保证检察权全面公正高效行使、保证检察官依法独立行使检察权和统一分级设置三项原则。最后,结合正在推进的司法改革,对现行法律规定提出了修改建议。
The organization of the procuratorial organs is an important part of the procuratorial organization, which is the focus of the revision of ＂People ＂s Procuratorate Organizational Law＂. This paper analyzes the exist- ing problems, causes and effects of the internal organs in the standard, the name, the quantand the dispatching or- ganization, and then puts forward that the establishment of the procuratorial organs should follow the guarantee of procuratorial power comprehensive and efficient exercise, to ensure that the prosecutor in accordance with the law independently exercise the power of prosecution and unified classification of the three principles. Finally, in line with the judicial reform is being promoted, the proposed changes to the existing legal recommendations.
