摘要
业主维权在一定程度上重构了城市社区治理的规则和格局。已有的研究和实践则为城市社区治理提供了两种模式:政府主导下的居委会、业委会、物业公司及业主协调解决纠纷的模式与业主委员会自管的模式。前者多出现于业主力量弱、文化素质相对低的社区,后者多出现于业主维权意识强、组织能力强且文化素质相对高的社区。在现阶段,两种治理模式仍然依赖于领导精英,不具有普遍性。随着业主组织能力的增强、治理能力的提高及国家、市场和社会在社区治理中职能定位的逐渐明确,城市社区治理的规则和格局将会更加清晰。
Homeowners＇ right protection reconstitutes to some extent the rules and scenario of urban community governance. Existing researches and practices provide two governance patterns： governmentdominated one with residents＇ committees, homeowners＇ committees, property companies and homeowners coordinating to solve disputes, and autonomy one by homeowners＇ committees. The former is often seen in the communities where the homeowners with relatively lower education are not capable to defend their benefits, while the latter is in the communities where homeowners with better education, better organization capability and more sense to protect their rights. Nevertheless, both patterns rely on elites＇ leadership which cannot be popularized. With the development of homeowners＇ organization and management capabilities, and more clarified functions of state, market, and society in community governance, the rules and scenario of urban community governance will become clearer.
