摘要
从供给侧端界定共享经济,劳动力资源作为平台的核心人力资本是稀缺的和有限的。共享经济平台应对分散化的劳动力资源进行组织、协调和管理。与传统雇佣组织相比,共享经济用工模式表现出的最大特征是:平台对劳动过程的控制和劳动者拥有工作自主权是同时并存的。所以,共享经济平台应该承担起劳动者在在线劳动过程中的雇主责任,而劳动者在离线或准备接单时间内与平台的关系,目前仍存较大争议。文章最后提出共享经济平台应建立超越雇佣和组织的平台人力资本管理体系。
From the new viewpoint to redefining the sharing economy based on supply, labor resources are key human capital, and they are scare and limited. The platform of sharing economy should organize, coordinate and manage these dispersive labor resources. Compared with the traditional employment organization, the character of the mode of employment is that the labor control from platform and the work autonomy of labors are coexistence on the sharing economic platform. The platform should assume the employer's obligations when labors worked online. However, there are some disputations about the relations between labors and the platform when labors are off- line and in the process for preparing to receive orders from platform. We propose the platform should establish the system of human capital management on the platform in the end of this paper.
