摘要
刑事案例指导制度在司法适用中屡遭冰点的原因之一是司法人员参照意识薄弱,案例分析、识别能力欠缺。因此,提升司法人员的法律适用能力尤为重要。以案例指导制度对法律职业化发展的影响为视角,指出应在坚持务实、专业的基本方向下,重视指导案例的理论价值和实践运用,从案例的选取、呈现、剖析等多角度培养多向法律思维,提升实践能力,促进案例指导制度与司法实务的有效对接和共同发展。
The reason why the criminal case guidance system is repeatedly hit a freezing point in the judicial application is that the judicial personnel have weak referential consciousness,lack of case analysis and identification capabilities. It is very important to improve staffs＇ practical ability of the judicial application. From a new perspective of the influence of the case guidance system on legal professionalization,this paper points out we should focus on the academic and practical value of guidance case under the pragmatic and professional direction. In addition,we should cultivate legal thinking and improve practical skill by selecting,showing,analyzing cases in order to promote the effective alignment and coordinated development of criminal case guidance system and judicial practice.
