摘要
"死船"法律制度是美国海事法下一项重要的法律制度,对于确定船舶的法律地位、法律适用和海事管辖权都非常重要,长期以来中国海商法学术界缺乏对此问题的研究。通过梳理过去二百年间美国这一法律制度的典型判例,分析"死船"能否构成船舶优先权客体的判断标准,有助于进一步丰富和完善船舶优先权法律制度;"死船"的法律地位不是一成不变的,同一船舶在不同的法律关系下,其法律地位不同。这一法律制度在美国法下还有待进一步发展完善,当前不宜引入中国海商法。
The "dead ship"doctrine is a special regime under American admiralty law which is of importance in determining the legal status of vessels,applicable law and maritime jurisdiction,however,it is also an area that has been paid little attention for a long time by maritime scholars in China. Having reviewed most of the precedents related to dead ships under American case law in the last two hundred years,the paper analyzed the tests in determining when the dead ships are objects of maritime lien,and concluded that one vessel may be qualified as a ship in law with one party whilst she may be not with another party in the same scenario. Aiming to perfect the regime of maritime lien under Chinese law,the paper suggested not adopting the American "dead ship"doctrine in China,as it is still in the development under American law.
