摘要
法律儒家化作为瞿同祖先生考察中国古代法律的结论性命题,在学界产生了广泛的影响,但这一命题对儒法合流的展现是不清晰的。透过儒家与法家所处的不同视角的观察,可以发现以荀子对儒学理论"礼法并用"、"以礼统法"的改造为基础,晚出儒家开始占据意识形态领域的统治地位,并通过儒学法律化实现了由理论向制度的转变。而在"纯本于法家精神"的法律体系被儒家化的过程中,法家逐渐被儒家吸收同化,独立意义上的法家学派失去了存在的价值。
Legal Confucianism, as the concluding proposition of Qu tongzu's investigation into the ancient Chinese law,has had a wide influence in the academic circle, but this proposition is not clear to show the confluence of Confucianism and law. Through the observations of different perspectives of Confucianism and Legalism, we can find that the transformation of Hsun Tzu Confucianism's theory of "the combination of li and law" and "li guides law" is based on the transformation of Confucianism into the dominant position in the field of ideology. And through the legalization of Confucianism, the transformation from theory to system has been realized. While the legal system of "pure in the spirit of legalism" was Confucian,legalism was gradually absorbed and assimilated by Confucianism, and the legalism school in the independent sense lost its value of existence.
