摘要
网络直播平台色情行为不仅突破既有前置性规范的治理边界,也给现有刑事规范的调整带来"不适"。有必要借鉴域外经验,协调自由保障与行为规制、网络发展与法益保护的关系,发挥刑法审慎介入的谦抑"品性",健全相关行政法律法规和行业自律性规范,理顺传播淫秽物品(牟利)罪、聚众淫乱罪、组织淫秽表演罪的解释分歧,并确立公然猥亵罪,以规范网络直播平台色情行为的治理。
The erotic behavior on the live online platform not only breaks the governance current front norms,but also causes disharmony to the adjustment of the existing criminal norms.It isnecessary to learn from the effective experience outside the domain,and to coordinate the relationship betweenfreedom protection and behavior regulation,between network development and legal protection.Toregulate the behavior,China need to display the modest restraining role of criminal law,improve laws and occupational standards,straighten out the interpretation dispute of crime of propagatingobscene articles,crime of spreading pornographic materials for profit-making,crime of assembling acrowd to engage in sexual promiscuity,crime of organizing an obscene performance,and establish thecrime of public indecency.
