摘要
程序法是有关"活动"的法。程序法分别指向各个具体的重要社会活动,是专门调整特定社会活动的法律系统,是针对特定社会活动而预置的法律行为规则的集合体。一个国家的全部法律是分层次对社会发生作用的行为规范系统。法律对社会发生作用的层次可以分为三级:分别是构建或形成法律秩序;救济或保障法律秩序;净化或强化法律秩序。相关的法律亦可据此划分为:形成法律秩序的法;保障法律秩序的法;净化和强化法律秩序的法。程序法亦以此分为:形成或构建法律秩序的程序法;救济或保障法律秩序的程序法;净化或强化法律秩序的程序法。三大类型的程序法依次属于递进关系,其中后继的程序法总是兼有前面层次程序法的部分或全部功能。
Procedural lawis activity law.The procedural law refers to each specific important social activity.It is a legal system that specifically adjusts specific social activities.It is a set of legal behavior rules that are preset to corresjDond to specific social activ-ities.The entire law of a countp is a behavioral normative system that acts on society at d/ferent levels.There are three types of laws that correspond to different levels.In general,the role of law in society can be divided into three levels:constructing or forming a le-gal order,relieving or safeguarding the legal order,and purifying or strengthening the legal order.In general,the level of the role of lawin society can be divided into three levels:constructing or forming a legal order,relieving or safeguarding the legal order;purif-ying or strengthening the legal order.So,the relevant laws can also be divided into three kinds:a law that forms a legal order,a law that guarantees legal order,and a lawthat purifies and strengthens the legal order.The procedural law is also divided into three types:the procedural lawthat forms or constructs the legal order,the procedural lawthat remedies or protects the legal order,and the procedural law that purifies or strengthens the legal order.The three major types of procedural law are in a progressive relationship in which the subsequent procedural lawalways has some or all of the functions of the previous hierarchical procedural method.
