摘要
宅基地使用权抵押是农地产权流转的重要形式之一,不仅能盘活宅基地产权、开拓农民融资渠道,还有利于发展农村经济、促进农村金融改革。我国当前的法律规则、土地政策与实践现状都为宅基地抵押的推广奠定了基础。然而,宅基地使用权抵押面临着一系列现实困境,制度层面包括立法体系不完善,抵押人、抵押权人范围不明确,抵押登记制度不健全,抵押权难以实现等;配套机制层面包括风险保障机制缺位、缺乏专门的价值评估机构与农地金融机构等。对此,应当对立法作出调整,并结合试点经验逐一完善。
Mortgage of land use right is one of the important forms of farmland property rights transfer.It can not only revitalize the property rights of homesteads,open up farmers’financing channels,but also help develop rural economy and promote rural financial reform.China’s current legal rules,land policies and practice status have laid the foundation for the promotion of homestead mortgages.However,the mortgage of the right to use the house site faces a series of realistic dilemmas.The system level includes the imperfect legislative system,the mortgagor,the mortgagee’s scope is not clear,the mortgage registration system is not perfect,and the mortgage is difficult to achieve.The supporting mechanism includes risk protection,lack of mechanisms,lack of specialized value assessment institutions and agricultural financial institutions.In this regard,legislation should be adjusted and combined with the pilot experience to improve one by one.
