摘要
义乌通过宅基地“三权分置”改革实现了宅基地使用权的合法流转,但在改革中,地方政府角色转变较为复杂, 可以变为一个政策制定者、市场建设者、市场监督者和利益共享者等,而中央政府的角色较为固定,始终扮演着一个政策 框架制定者与监督者角色。为了保证改革中利益分配的公平,各级政府应该端正自身角色,防止越权;同时,改革应该通 过立法加以完善。
Yiwu has realized the legal transfer of the right to use the homestead through the reform of the“ separation of the three powers”.However, the role of local government is very complex, which can be a policy maker, a market builder, a market regulator, and a benefit sharer. The role of the central government is relatively fixed, being always a policy framework maker and an overseer. In order to ensure the fairness of the distribution of benefits in the reform, it is believed that governments at all levels should know well their own roles and refrain from exceeding their powers. At the same time, the reform should be improved through legislation.
