摘要
贪污贿赂犯罪侵犯的法益不同,其社会危害性也明显不同,又因为贿赂犯罪是统一的整体,所以,对贪污罪和贿赂犯罪进行类型化划分,并在贿赂犯罪的统一语境下合并行贿罪、受贿罪条款意义重大。要改变现行刑法对贪污罪和受贿罪做相同刑罚处遇的立法模式,首先将受贿罪的刑罚从贪污罪中独立出来,然后再根据行贿罪、受贿罪对向犯的特征对其犯罪构成和刑罚处罚做一体规定,从而实现行为的类型化和处罚的科学化。
Corruption and bribery offenses infringe different legal interests and have different social harmfulness.In addition,bribery crime is a unified whole,so it is of great significance to classify the crime of corruption and bribery,and to merge the provisions of bribery and bribery crime under the unified context of bribery crime.To change the current criminal law’s legislative mode of punishing corruption and bribery in the same way,the penalty of bribery should be separated from the crime of corruption,and then the Constitution and penalty of the accomplice should be stipulated in accordance with the characteristics of the crime of bribery and the crime of accepting bribes,so as to realize the typification ofbehavior and thescientificof punishment.
