摘要
邮轮旅游的旅行社包切舱模式曾饱受业内诟病,并被认为是中国邮轮市场衰落的主要原因。然而2019年中国邮轮市场回暖后,旅行社包切舱模式仍然占据主流地位。对中国特色的邮轮包切舱模式进行法律研究,梳理包切舱模式下旅行社、邮轮公司、邮轮旅客之间的法律关系和权利义务,仍然有重要的理论和现实意义。以国内外运输法和旅游法为视角,参考邮轮产业发达国家相关法律和判例可知,海商法应重点调整邮轮公司与旅行社、邮轮公司与旅客之间的关系,并对邮轮包切舱模式的海商法规制提出相应立法建议。
The dissimilation of the Chinese-featured cruise ship charter-tour mode was once criticized as the main reason for the sharp decline of China’s cruise market in 2018.However,as China’s cruise market rebounded in 2019,charter-tour mode still occupy the mainstream status.Therefore,it is of great theoretical and practical importance to continue the research on cruise ship charter-tour model with Chinese characteristics and clarify the relationship among travel agencies,cruise ship companies and cruise ship tourists.In the perspective of domestic and exotic maritime and tourism law and cases,maritime law should focus on the legal relationships between cruise companies and travel agencies,cruise companies and passengers.Furthermore,more feasible suggestions for Chinese maritime law has been made on the regulation of the Chinese cruise ship charter-tour mode.
