摘要
传统理论中,行政一体原则被限缩在"组织一体"的狭窄范围内,其确保手段表征为上下级机关间的科层结构和层级命令关系。现代社会,限缩为"组织一体"的行政一体原则已无法有效应对行政组织分散化的行政实务,亟待更新以适应社会治理"去中心化"和"去官僚化"的需求。然而,域外普遍采取的回归"责任一体"的方案与"组织一体"在本质上分享着同样的理论基础--规范主义,其现实解释力相当有限,更为可行且符合中国实际的更新方案是以功能主义作为行政一体原则的理论基础,并以此重塑行政一体的确保手段。当然,为了避免"泛功能论"的倾向,更新后的行政一体原则也有一定的适用限度,不仅应与行政分权和行政自治保持平衡,也应严守行政法定原则的适用边界。
In the traditional theory,the doctrine of administrative integration is limited to the narrow scope of"organizational integration".It is expressed as the hierarchical structure and hierarchical command relationship between the higher and lower organs.In modern society,the doctrine of administrative integration with"organizational integration"as the core has been unable to effectively deal with the administrative practice of diversification of administrative tasks and decentralization of organizations.It is urgent to update its ideas and contents to adapt to the needs of"decentralization"and"de-bureaucratization"of social governance.However,the universally adopted"responsibility integration"share the same theoretical basis with"organizational integration",and its realistic explanatory power is also quite limited.A more feasible and in line with China’s reality update plan is based on the theory of functionalism as the theoretical basis of the doctrine of administrative integration.Of course,the updated doctrine of administrative integration also has certain limits of application.It should not only maintain a balance with administrative decentralization and administrative autonomy,but also strictly abide by the applicable boundaries of the doctrine of administrative statutory.
