摘要
多矿种共伴生是矿产资源基本特征之一。文章通过概念辨析、司法案例分析、国外法律借鉴等研究方法和手段,针对共伴生矿定义过于学术化,法律定义不清,与管理实践衔接不到位,影响司法审判和矿业权管理实践的问题,分析共伴生矿的实际内涵和形成机理、主要管理目标,借鉴国外相关法律规定,从严格管理与促进资源综合利用的角度,探索解决这些司法与管理面临的问题,提出规范共伴生矿法律定义、完善矿业权管理内容等相关建议。
That multiple minerals are symbiotic-associated is one of the basic characteristics of mineral resources.Through the research methods of concept discrimination,judicial case analysis and foreign law as reference,the paper points out the following problems which affect the judicial trial and the practice of mining rights management,there are the definition of symbiotic-associated minerals is too academic,the legal definition is unclear,and the connection with management is incomplete.In order to solve these problems in the judiciary and management,the paper analyzes the actual connotation and formation mechanism of symbiotic-associated minerals and main management purpose,takes the relevant foreign laws and regulations as reference,studies from the perspective of strict management and comprehensive utilization of resources,and then puts forward relevant suggestions:they are standardizing the legal definition of symbiotic-associated minerals,improving the management of mining rights and so on.
