摘要
个人信息是当代公共信任系统建设的物质基础,是社会物质生产与再生产的中枢性要素。但基于智能技术分析后的信息常常面临被滥用或泄露等问题,必须加强个人信息保护的法律规制研究。欧盟《通用数据保护条例》(GDPR)立法具有深厚的法律文化背景,通过顶层制度设计来协调用户与数字产业之间的关系,不但充分保障数据主体权利,为其提供更优质的服务,也是为了完善数据控制者、数据处理者的权利和义务,为数字产业营造有序的发展环境,推进数字产业繁荣发展。从法理和司法实践看,数字技术和智能技术发展使传统生产行业的消失、跨界越来越频繁,GDPR实施后必将面临法治理性与市场理性冲突、人格权与财产权矛盾以及立法理念与"行政-司法"救济实践之争等挑战。我国应借鉴欧盟《通用数据保护条例》立法理念,从法律、社会治理以及信息产业等维度构建个人信息双轨保护制度。
Personal information is the material foundation of contemporary public trust system construction and the central element of social material production and reproduction.However,the information analyzed based on intelligent technology is often faced with problems such as abuse or disclosure,must strengthen the legal regulation of personal information protection research.General data protection regulations legislation has profound legal culture background,GDPR through the top-level system design to coordinate the relationship between the user and the digital industry,not only fully protect the rights of the data subject,to provide more quality services,and to improve the rights and obligations of data control,data processing,construction and orderly development of digital industry environment,promote the development of digital industry boom.From the perspective of jurisprudence and judicial practice,the development of digital technology and intelligent technology makes the traditional production industry disappear and cross borders more and more frequently.After the implementation of GDPR,it will be confronted with such challenges as the conflict between legal rationality and market rationality,the conflict between personality right and property right,and the dispute between legislative concept and"administration-justice"relief practice.In China,we should learn from the European Union"general data protection regulations"legislation idea,from the legal dimension,the social governance dimension and the information industry dimension constructs the personal information Double-track protection system.
