摘要
"苏格拉底自辩"与"艾希曼自辩"均极为严肃地提出了道德义务根据及其合理性限度问题。根据黑格尔的看法,义务是尽本分,"尽本分"有伦理与道德两个方面。具体伦理秩序中的规范性要求是伦理的义务,出于良知听从心底声音要求是道德的义务。前者的精义是坚持伦理秩序的规范性职责要求,后者的核心是听从良心的声音。在现代法治社会,道德义务的根据既不是纯伦理的,也不是纯道德的,而是在伦理与道德之间的、弱意义上的伦理优先,即在坚持宪法法治秩序优先的同时也为良心保留了空间。
Both the Apology of Socrates and Eichmann’s self-defense discuss at length the basis and reasonableness of moral obligation. Hegel observed that there are two aspects to obligation: ethics and morals. The former refers to the social norms and the latter means the power of conscience. In a modern society with rule of law,the basis of moral obligation is both ethical and moral though ethics slightly outweighs morals.
