摘要
体系解释的逻辑意蕴是塑造法治思维的必备成分。忽视体系解释的逻辑维度,不仅会酿成过度文义解释的机械执法、司法,还极易在法律与其他社会因素的关系思辨中丢失法律的确定性和权威性。体系解释在我国的演进历史表明,逻辑必将成为当代中国法律解释的理论支点。因而需要对体系解释进行"方法意识、思维依据、操作规则"层面的逻辑展开,在细分法体系要素的基础上,塑造以探寻逻辑一致性为目标的操作规则。体系解释的逻辑展开,对促进法律规范的体系性适用、矫正传统思维侵蚀法意、证成体系解释的黄金解释规则属性等都将发挥重要作用。
The logical aspect of systematic interpretation is an essential component of shaping the thinking of the rule of law. Ignoring the logical dimension of systematic interpretation will not only lead to mechanical law enforcement and justice owing to strict literal interpretation, but also easily lose the certainty and authority of law in the dialectical relationship between law and other social factors. The evolution of systematic interpretation in China shows that logic will become the theoretical fulcrum of Chinese contemporary legal interpretation. Therefore, it is necessary to carry out the logical expansion of "method consciousness, thinking basis and operational rules" of the systematic interpretation, and on the basis of subdividing the elements of the law system, shape the operational rules aimed at exploring logical consistency. The logical expansion of the system interpretation will play an important role in promoting the systematic application of legal norms, rectifying traditional thinking to erode the legal meaning, and proving the attribute of golden interpretation rules of system interpretation.
