摘要
在"范畴与法理对接"的视角下,知识产权法基本范畴中蕴含着特殊法理。知识产权法基本范畴中的特殊法理应当揭示知识产权、知识产权法的特有规律,从内部视角阐明特殊学理并契合知识产权法的时空特性。借助传统范畴理论预设的本体、运行、进化、价值等范畴框架,我们可以发现知识产权法中的特殊法理。知识产权法的本体包含着知识产品具有创造性、知识产权的私权属性、知识产权法"如何配置权利"的特殊法理;知识产权法的运行包含着行政权力介入知识产权运行、侵权损害赔偿的特殊法理;知识产权法的进化包含着从"特权"向"私权"演进、科学技术作用于知识产权客体的特殊法理;知识产权法的价值包含着"创新"价值和"平衡"价值的特殊法理。知识产权法基本范畴中的特殊法理是以体系化的形式存在的,该体系由基石性特殊法理、建构性特殊法理和调节性特殊法理构成。
From the perspective of"docking category and Fali", the basic category of intellectual property law contains special Fali. The special Fali in the basic category of intellectual property law should reveal the special laws of intellectual property and intellectual property law, and clarify the special Fali from the internal perspective and fit the space-time characteristics of intellectual property law. With the framework of ontology, operation, evolution and value, we can find the special Fali in intellectual property law. The ontology of intellectual property law includes the special Fali of intellectual property law, for example,"knowledge products are creative", the private nature of intellectual property and how to allocate rights in intellectual property law. The operation of intellectual property law includes the special Fali of administrative power involved in the operation of intellectual property and tort damages. The evolution of intellectual property law includes the special Fali of evolution from"privilege"to"private right"and the acting of science and technology on intellectual property object. The value of intellectual property law includes the special Fali of"innovation"and"balance". The special Fali in the basic category of intellectual property law exists in the form of systematization, which consists of foundational special Fali, constructive special Fali and regulatory special Fali.
