摘要
生态安全观是国家总体安全观的重要组成部分。在我国警察实定法上,从多年来的警察立法实践中可以找到生态安全治理的清晰脉络。在警察法视阈中,参与生态安全治理是警察自身应有之义,是警察积极行政和协助诸般行政功能的重要体现。生态环境警察事权是央地共管事权,应以设立专门警察机关和省或市级以下垂直领导体制为基本思路,构建中国特色社会主义生态环境警察制度。
The ecological security concept is an important part of the overall national security concept. In terms of the actual law of China’s police,we can find a clear vein of ecological security management from years of police legislation practice. From the perspective of police law,participating in ecological security management is the obligation of the police,and it is an important reflection of the police’s active administration and administrative functions. The power of ecological environment police is the power of central and local condom-management,so we should build the socialist ecological environment police system with Chinese characteristics by setting up a special police organ and a vertical leadership system below the provincial or municipal level.
