摘要
随着人类经济的发展,知识经济时代悄然来临,劳动力也不再只是单单指代人类个人本身,而是更多地表现在人的专业知识与技能上。因而,为了顺应时代的变迁,人力资本的理论油然而生。其中,人力资本的概念在公司法律制度上面的影响是日渐深刻,人力资本的的理论在法学应用中也是越发重要。本文将立足于对人力资本法律特征上进行分析探讨,以期为人力资本在法学法律中的完善和运用提供一定的参考价值。
With the advent of knowledge economy era,the connotation of“labor force”has been enriched.It no longer merely refers to laborers themselves,but more implies their professional knowledge and skills.Therefore,Human Capital Theory arises in order to adapt to the changing times.As the concept of human capital increasingly influences the corporate legal system,the application of Human Capital Theory to laws becomes more and more important.This paper gives an overall analysis of the legal characteristics of human capital,hoping to provide reference for other research on the application and improvement of human capital in law and legislation.
