摘要
为实现法学理论中国化,须立足于传统文化的义理与话语,重新梳理本土理论资源。传统中国虽无法理学之名,亦无体系严整的专论专著,然而确有内容含弘博大的一系列法学理论散见于各家论说之中,且主要的理论问题和论域在先秦两汉便已开出。结合先人对世界“体—相—在”结构的把握,以先哲对“法”概念在相、在两域的特殊体认为基础,融会各家所论可将传统法理体系化为道法学、法术论和律令学三大论域。道法学以体、相关系论法,涉及法的正当性、合法性问题。法术论聚焦“在”的层次中的法之为“用”,即作为治理术的法和按法而治的问题。律令学研讨“在”域之中法之为“器”,即法律规范的应用与解释问题,其中包含狱讼的理论与技术和律学两方面。
In order to realize the localization of legal theory,it is necessary to rearrange the native theoretical resources based on the traditional cultural theory and discourse.Although traditional China does not have the concept or the monograph in jurisprudence,it does have a series of legal theories which spread in various theories,and the main theoretical issues and discussion areas have been established in the pre-Qin period.Based on the understanding of the structure of“Root-Universals-Reality” of the world by the sages,the special understanding of the concept of law by the ancient philosophers,the system of traditional legal theory can be divided into three fields:theory of legal rationality,theory of rule of law and theory of justice and legal interpretation.Theory of legal rationality discusses law under the relationship between Root and Universals,which involves the legitimacy and legality of law.The theory of rule of law focuses on the use of law at the level of Reality,that is,the problem of the law as governing and governing art according to law.Theory of justice and legal interpretation is also in the field of Reality,which study of the application and interpretation of legal norms,including the theory and technology of judicial and legal interpretation.
