摘要
《粤港澳大湾区发展规划纲要》实施后,大湾区一体化建设提升为国家战略,为创新检察民事公益诉讼区际司法协作机制提供了契机。目前,检察民事公益诉讼区际司法协作存在协作领域局限、协作方式滞后和协作制度差异较大等问题,一定程度上影响了大湾区一体化发展。内地检察机关和港澳司法部门应深化检察民事公益诉讼区际司法协作,在积极稳妥办理法律授权领域内公益诉讼案件的基础上,积极探索“等外”领域;在全面开展粤港澳司法交流合作的基础上,探索区际司法协作发展模式;在尊重三地法制差异性的基础上,建立跨区际案件集中管辖制度,以期推进大湾区检察民事公益诉讼司法协作机制常态化、高效化和制度化运行。
After the Layout Plan of Guangdong-Hongkong-Macao Greater Bay Area was put into effect,the integrated construction of the Greater Bay Area has become a national strategy,which offers a new opportunity for the interregional judicial cooperation of the prosecution of civil public interest litigation.At present,there are problems such as the limitation of cooperation area,backward in cooperation mode and systematic difference,which,to a certain degree,hamper the integrated construction of Grater Bay Area.In the future,the cooperation between the procuratorial organs of China's Mainland and Hongkong and Macao shall be based on properly handling the civil public interest cases in the area of legal authority,and at the same time positively explore the“off grade”area.On the basis of judicial cooperation in Guangdong,Hong Kong and Macao,we must explore interregional cooperation mode.On the premises of mutual respect,we shall construct an interregional centralized jurisdiction system to promote the normalized,efficient and systematized judicial cooperation mechanism of civil public interest litigation.
