摘要
以初始排污权分配问题为研究对象,综合运用比较分析法和逻辑演绎法,在比较以往各种初始排污权分配模式和方法的基础上,分析和评价各种分配模式和方法的优点与不足,提出适合中国国情的初始排污权分配模式与方法,探讨中国初始排污权分配模式与方法的未来发展趋势。研究认为:从时间维度上来说,中国的分配模式应逐步从无偿分配模式过渡为混合分配模式,进而发展为有偿分配模式;制度实施初期可先采取“自下而上”的分配模式,在各个试点积累了丰富经验且行政能力显著提高后,再利用中国单一制国家的体制优势,采取“自上而下”的分配模式。从空间维度上来说,在经济相对发达、交易机制相对成熟的地区,有偿分配模式应占主导地位;反之,无偿分配模式则应占主导地位。
Taking the allocation of initial emission right as the research object,the comparative analysis and the logical deduction methods are comprehensively used to analyze and evaluate the advantages and disadvantages of various modes and methods of allocation,so as to come up with the allocation mode and methods of initial emission rights suited for China’s national conditions and to further discuss the future development trend of China’s allocation mode and method of initial emission rights.According to the research,from the perspective of time,China’s allocation mode should gradually transit from the unpaid allocation mode to the mixed allocation mode,and then to the paid allocation model;the country can adopt the bottom-up allocation mode in the initial stage of the implementation,after that a up-bottom allocation mode can be used with rich experience accumulated and administrative capacity significantly improved,taking the advantage of the institutional advantages of China’s unitary state.From the spatial aspect,the paid allocation mode should dominant in the areas with relatively developed economy and the relatively mature trading mechanism.On the contrary,the unpaid allocation mode should dominate.
