摘要
刑罚目的理论经历了从报应论到预防论再到综合论的演变。单一的刑罚目的理论很难实现对刑罚正当性作出全面的解释,而综合论通过简单的观点折中也并未解决报应主义与功利主义之间的矛盾。刑罚目的其意义在于表达,这种表达兼具回溯性和前瞻性,既可以指向特定的犯罪主体,也可以面向不特定的公众。通过这种架构,实现了在不同阶段向不同主体发挥刑罚的不同功能。
The theory of the purpose of punishment has evolved from the retribution theory to the prevention theory.It is difficult to make a comprehensive explanation of the justification of punishment by a single theory of the purpose of punishment,and the comprehensive theory fails to solve the contradiction between retributivism and utilitarianism from a simple point of view.The significance of the purpose of punishment lies in its expression,which is both retrospective and forward-looking and can be directed to the specific subject of the crime as well as to the non-specific public.Through this framework,different functions of penalty are realized to different subjects at different stages.
