摘要
面对具有高度不确定性风险的“突发原因不明的传染病”,依法治理的关键在于设计良好的行政程序,科学、及时地将其列入“法定传染病”。较为理想的法定化方式是颁布行政基准,以明确“暴发、流行”的情形;建构专家咨询组织与完善专家咨询程序,为疫情防控提供决策咨询,精准研判“危害程度”。
In the face of highly uncertain risks of“sudden infectious diseases with unknown causes”,the method of governance according to law is to design good administrative procedures and scientifically and timely include them into“statutory infectious diseases”.The more ideal way of legalization is to issue administrative standards to clarify the situation of“outbreak and epidemic”,establish expert consultation organizations and improve expert consultation procedures,provide decision-making consultation for epidemic prevention and control,and accurately study and determine the“harm level”.
