摘要
当前我国公共图书馆应急公共文化服务的立法保障包括宪法、图书馆专门法、部门规章、地方性立法及其他相关法规,但公共图书馆应急公共文化服务职能的规定还不完善且有所缺失,专门法中法人治理结构规定有待补充,特定、具体的图书馆危机应急管理制度以及地方性立法规范存在缺陷等。为保障公共图书馆应急公共文化服务,必须健全《中华人民共和国公共图书馆法》的相关规定,制定《公共图书馆突发事件应对条例》和完善地方性立法,强化区域内公共文化服务应急体系的建立。
At present,the legislative guarantee for emergency public cultural services of public libraries in China include the constitution,the special law of library,departmental regulations,local legislation and other related regulations.However,the provisions of emergency public cultural service function of public libraries are not perfect and even missing,the provisions of corporate governance structure in the specialized law need to be supplemented,and there are defects in the specific and concrete library crisis emergency management systems and local legislative norms.Therefore,in order to guarantee the emergency public cultural services in public libraries,it is necessary to improve the relevant provisions of the Public Library Law of the People’s Republic of China,formulate the Public Library Emergency Handling Regulations,and improve local legislation to strengthen the establishment of public cultural service emergency system in the region.
