摘要
随着科技的进步与市场经济的高速发展,虚拟现实技术业已成为信息领域中继人工智能技术、网络技术、多媒体技术之后被广泛开发与应用的热点,但随之引发的著作权侵权风险与乱象难题亦日益凸显。本文以虚拟现实技术的理论研究为切入点,在探析虚拟现实三维数字模型转换的技术原理与实践困境基础上,进一步分析该项技术涉及著作权客体与内容的适格要件与规制范围,并从“独创性判断—异维复制—合理使用”三重视角深度剖析虚拟现实三维数字模型应用中的可版权性、合法性与利益权衡考量等问题,以促进虚拟现实技术之科技创新和法治回应的动态均衡发展。
With the advancement of science and technology and the rapid development of the market economy,the virtual reality technology has become a hot spot in the field of information,which has been widely developed and applied after the artificial intelligence technology,the network technology,and the multimedia technology.However,the resulting risks of copyright infringement and chaotic problems have become increasingly prominent.This paper,starting from the theoretical study of the virtual reality technology,further analyzes the qualified requirements and regulatory scope of the technology related to copyright objects and content and based on the exploration of the technical principles and practical dilemmas of virtual reality 3D digital model transformation.Besides,it also analyzes the copyright ability,legitimacy,and benefit trade-off considerations in the application of virtual reality 3D digital models from a triple perspective of“original judgment-dimension copied-rational use”,in order to promote the technological innovation of the virtual reality technology and the response to the dynamic equilibrium development of the rule of law.
