摘要
职业足球运动员是职业足球运动发展的核心要素,发展职业足球运动最根本的在于职业足球运动员人力资本价值的实现。站在新制度经济学的角度剖析人力资本产权的学理概念,通过阐述我国职业足球运动员人力资本产权交易的基本属性和特殊性,提出在职业足球运动员人力资本产权形成阶段,主要通过培养复合型球员和建立科学的青训模式来降低投资的不确定性和正外部性,以及分阶段治理以维护投资专用性;使用阶段则采取建立完善的法律权利体系、契约保障制度和建立双边垄断的职业足球运动员人力资本要素市场的方式,调整职业足球运动员人力资本供需并实现其科学的自由流动,维护职业足球运动员人力资本产权交易的合理性并促进产权交易顺利进行。
Professional football players are the core elements of the development of professional football.The most fundamental of the development of professional football lies in the realization of the value of professional football players’human capital.From the perspective of new institutional economics,this paper analyzes the theoretical concept of human capital property rights.By elucidating the basic attributes and particularity of human capital property rights transaction of professional football players in China,it puts forward that in the formation stage of human capital property rights of professional football players,the uncertainty and positive externality of investment can be reduced mainly through the cultivation of compound players and the establishment of scientific youth training mode,so as to improve the quality of investment;In the use stage,we should establish and improve the legal rights system,contract protection system and establish a bilateral monopoly market of human capital elements of professional football players,adjust the supply and demand of professional football players’human capital,realize its scientific free flow,and maintain the rationality and efficiency of professional football players’human capital property rights transaction and promote the smooth progress of property rights transaction.
