摘要
根据不同认定标准,我国夫妻共同债务可分为"双方合意型"债务、"日常家事代理型"债务和"共同生活、共同生产经营型"债务三种。不同类型夫妻共同债务应当区分适用不同清偿规则。对于"双方合意型"债务,夫妻应以全部财产承担连带清偿责任;对于"日常家事代理型"债务,双方应首先以夫妻共同财产清偿,不足部分由各方以个人财产承担连带清偿责任;对于"共同生活、共同生产经营型"债务,双方应首先以夫妻共同财产清偿,不足部分由举债配偶方以个人财产承担清偿责任,仍不足清偿的,由非举债配偶方以个人财产承担补充清偿责任。我国修改《妇女权益保障法》时,宜在"婚姻家庭权益"一章增加规定夫妻共同债务清偿规则。
According to different identification standards,the joint debts of couples in China fall into three categories as"consensual type of couples","general housework agency type"and"co-living and joint production and management type",in which different types should be distinguished and applied with different payment rules.For"consensual type of couples"debts,both spouses should bear joint and several liabilities with all assets;for"general housework agency type"debts,both spouses should first pay off with the joint property of the couples,and each of the spouses shall bear the joint liability for payment of the shortfall with their personal property;for"co-living and joint production and management type"debts,both spouses should first pay off with the joint property of the couples,and the debtor spouse should bear the responsibility for paying the debts with his or her personal property.If the debt is still insufficient,the non-borrowing spouse should assume the supplementary responsibility for payment with personal property.China intends to revise the Law on the Protection of Women’s Rights and Interests,and it is appropriate to add rules for the payment of joint debts between husband and wife in the chapter"Marriage and Family Rights".
