摘要
当前,我国预审机构呈现多元化设置的状态,刑事预审制度核实证据、侦查监督核心功能流于形式,分流案件的基本功能缺失,承续侦查、深挖犯罪的功能逐渐退化。产生存续危机的原因在于:立法未及时顺应侦查体制的变化对预审制度的规范体系做出调整,未能构建起适应预审制度良性运行的组织系统,预审主体的履职能力与岗位需求不匹配。应基于现行刑事诉讼构造,构思改良方案,立足于刑事预审制度的本原功能,进行改良设计,加强预审队伍专业化建设,以实现预审功效职能的本位回归。
At present,our country’s hearing institution is plural set the state of the system of criminal pre-trial investigation to verify evidence,the supervision of core function become a mere formality,the basic function of shunt case is missing,bear the investigation,dig the crime function gradually degraded,cause the crisis of survival lies in:legislation does not conform to the changes in the detection system of pre-trial system in time to adjust the specification of the system,to build up the benign operation of the pre-trial system and organization system,the prequalification of role ability and position requirements do not match.Based on the current structure of criminal procedure,the improvement plan should be conceived,based on the original function of the criminal pretrial system,the improvement design should be carried out,and the professional construction of the pretrial team should be strengthened,so as to realize the standard return of the function of pretrial.
