摘要
目的为医疗机构数据内外部共享提供理论基础,促进我国健康医疗大数据应用落地与发展。方法基于利益相关者理论分析医疗机构数据共享相关方的利益和需求,结合访谈法挖掘相关者的潜在动机,梳理、分析归纳关键问题。结果健康医疗数据共享缺乏法律性规范和指导原则,所有权不明确,无共享目录、标准和规范,安全风险管控和责任缺乏权威认证等,均在不同程度上影响共享建设的实施和成败。结论建议针对社会环境、行业、医疗机构分别制定对应的数据治理法律法规和管理制度,确保健康医疗数据共享、利用有法可依,有章可循,保障健康医疗数据全生命周期的安全、质量和价值。
Objective This article aims to provide a theoretical basis for the internal and external data sharing in medical institutions,and to promote the implementation and development of healthcare big data applications in China.Methods Based on the stakeholder theory,this study analyzes the interests and needs of the stakeholders involved in data sharing in medical institutions,combines the interview method to mine the potential motivations of stakeholders,summarizes key issues,and proposes countermeasures of healthcare data governance.Results Healthcare data sharing lacks of legal norms and guiding principles,unclear ownership,no shared catalog,standards and norms,lack of authoritative certification for security risk control and responsibility for etc.,all of which affect the implementation and success of sharing construction to varying degrees.Conclusion It is recommended to formulate relevant data governance laws,regulations and management systems for the social environment,industry and medical institutions to ensure that there are laws and regulations to follow in the sharing and utilization of healthcare data,and to ensure the safety,quality and value of healthcare data throughout its life cycle.
