摘要
裁判文书说理写作可以分为立意、布局、选材、表达四个步骤,各步骤要解决的问题各不相同,但高度相关、相辅相成,共同影响说理的效果。立意是指明确裁判文书写作的目的,法官应当在一开始确定判决的核心观点、明确主要说理对象。布局是指从整体的角度谋篇布局,法官要从全局着眼,通盘布局、层次分明。选材是指法官根据特定的标准,确定用于说理的素材。表达则指法官以适当的方式呈现理由。
Judgment reasoning writing can be divided into four steps, intention,layout, selection of materials, expression, each to address different steps, but highly relevant, complementary, together affecting the effect of reasoning. Intention means to clarify the purpose of writing a judgment. The judge should determine the core viewpoint of the judgment and the main object of reasoning at the beginning. Layout means to plan the layout from the overall perspective. The judge should look at the overall situation, comprehensive layout and writing layers. Selection of material refers to the judge’s determination of the material to be used for reasoning based on specific criteria. Expression means that the judge presents the reasons in an appropriate manner.
