摘要
“三权分置”制度下,同一对象(土地)上设置的三种权利如何相处,最新衍生的土地经营权的行使边界在何处,仍需在理论上不断研究探索。映射到土地流转实践中,三方权利主体间的利益诉求极易形成冲突,进而引发纠纷。从土地经营权纠纷诉源治理视角看,必须“抓前端、治未病”,探究纠纷产生的根源,从源头加以预防。文章基于土地纠纷案件分析,以村集体(发包人)、村民(承包人)、经营企业(土地经营权人)三者之间的土地流转交易为切入,首先通过实证研究,分析土地经营权纠纷的典型表现;进而通过深入分析当事人的利益诉求失衡状况,评析常见的出租、入股、发包、反租倒包等流转方式的功能优劣;最后尝试以土地流转方式创新为维度,提出改进和优化流转方式、完善土地流转配套保障机制的建议。
Under the"three rights separation"system,how to get along with the three rights set on the same object(land)and where is the exercise boundary of the newly derived land management rights still need to be studied and explored in theory.In the practice of land transfer,the interests of the three parties are easily conflicted,which leads to disputes.From the perspective of governance of litigation source over land management rights,we must"grasp the front end and prevent future disease",explore the cause of disputes and prevent them from the source.Based on the case analysis of land disputes,the paper starts with the land transfer transactions among the village collective(employer),villagers(contractor)and operating enterprises(owner of land management rights),firstly analyzes the typical performance of land management right disputes through empirical research,then,through in-depth analysis of the imbalance of the interests of the parties,this paper evaluates the functional advantages and disadvantages of common transfer mode such as leasing,equity participation,contract awarding,contract after rent;finally,this paper tries to take the innovation of land transfer mode as the dimension,and puts forward suggestions on improving and optimizing the transfer mode and improving the supporting guarantee mechanism of land transfer.
