摘要
研究对中国食品广告的法律规制体系、虚假食品广告的具体体现,以及现行法律规制机制在治理虚假广告中存在的问题进行了分析,并在此基础上探索食品虚假广告法律规制机制的优化路径。提出在健全虚假食品广告法律规定的同时,应对相关法律规制机制进行梳理,加大职能部门的执法力度,对虚假食品广告形成更加有力的法律约束。
In this paper,the current legal system regarding deceptive food advertisements in China has been discussed deeply and issues of current legal system have been analyzed.To solve the issues,a way for optimizing food legal system was explored and several measures which assist to improve the legal system for eliminating deceptive food advertisements have been proposed.Overall,relevant legal regulations published domestically and intenationally should be sorted out and the law enforcement of government sectors should be enhanced to constrain people who want to advertise deceptive food information.
