摘要
本文将现有个人数据安全的治理理念划分为个人本位和数据本位。个人本位主张个人尊严和权利至上,易导致个人与技术之间的对立;数据本位则主张数据的自由生产和流通至上,易导向个人与数据之间的对立。两种理念都陷入零和博弈,都不同程度地忽略了个人数据安全的本质特征,包括场景性、流通性和叠加性。现有法规和技术在应对这些特征时举步维艰,故政府、企业和个人有必要通过合作理顺数据价值排序,克服定责困难,化解价值冲突和防范技术风险。论文提出的合作本位的个人数据安全治理理念即是指在依法依规的前提下,回归个人数据安全的本质特征,通过政府、企业和个人之间的协同治理弥补现有法规和技术的局限,在谋求安全中促进共同发展。该理念的落实机制包括沟通机制、资源共享机制和伦理机制。
This paper divides the existing governance concepts of personal data security into individual-oriented concept and data-oriented concept.The individual-oriented concept advocates the supremacy of individual dignity and rights,but it tends to intensify the antagonism between individuals and technology.The data-oriented concept advocates the free production and flow of data,but it leads to the antagonism between individuals and data.The two concepts result in zero-sum game because of the neglect of the essential characteristics of personal data security,including situatedness,mobility and superimposition.Existing regulations and technologies are still inadequate in addressing these characteristics.Therefore,it is necessary for the government,enterprises,and individuals to collaborate to straighten out the data value priorities,overcome the difficulty of responsibility identification,resolve value conflicts,and prevent technological risks.The collaboration-oriented concept of personal data security governance proposed by this paper is to return to the essential characteristics of personal data security under the premise of legal compliance,to remedy the limitations of existing regulations and technologies through collaborative governance among government,enterprises,and individuals,and to promote common development in the pursuit of security.The implementation mechanism of this concept includes communication mechanism,resource sharing mechanism and ethical mechanism.
