摘要
对于夫妻一方以夫妻共同财产打赏主播,打赏款是否应当返还的问题,因相关法律对直播打赏的合同性质定位不明确,同案不同判现象严重。部分法院认定直播打赏为网络消费行为,打赏人与直播平台构成网络消费合同;部分法院将直播打赏认定为赠与,打赏人与主播或平台之间构成赠与合同。究其根源,除法律对直播打赏合同性质定位不明外,主要原因是司法裁判未区分充值行为与打赏行为,导致直播打赏合同性质认定分歧、打赏款是否应当返还以及返还责任主体裁判差异。司法裁判应当区分充值行为与打赏行为,用户充值时与平台构成网络消费合同,用户打赏则为行使网络消费合同权利之具体形态,其与平台和主播之间均不成立新的合同关系。
Relevant laws do not clearly define the contract nature of the live broadcast rewards when one of the couple rewards with the joint property,so about the return of the reward similar cased often have different judgments.Some courts identify live rewards as online consumption,and the rewarding person and the live broadcasting platform constitute network service consumption contract,while others identify it as gift giving,and the relationship between the rewarding person and the anchor or the platform constitutes a gift contract.Apart from the unclear definition of the nature of reward contract,the main cause of this ambiguity is that the judicial judgment does not distinguish recharge behavior from reward behavior,which results in disagreement on the nature of live broadcast reward contract,the return of reward money and the subject of liability for the return.Therefore judicial judgment should distinguish between recharge behavior and reward behavior,for the former constitutes the network service consumption contract,and the latter is a specific form of exercising the right of network service consumption contract without producing new contractual relationship with the platform and the anchor.
