摘要
近年来全球主要国家和地区普遍加大了数字经济领域反垄断执法力度,呈现如下新动向:法律目标趋向多元化,规则体系加快完善;反垄断执法的针对性和力度显著增强;监管方式和手段更加灵活多样;设立新的部门,展开密集调研;对内回应经济和社会风险,对外争夺规则话语权。我国应增强反垄断的规范性、威慑力和协调性,进一步强化竞争政策的基础性地位。同时,积极推动新《反垄断法》有效落实,完善配套规则并重视国际协调。要持续提升对垄断行为的识别能力和救济效率,优化事前监管和临时性措施。鼓励共治共享和技术赋能,强化合规治理。进一步充实反垄断执法力量,探索相关机构设置的优化。
In recent years,major countries and regions around the world have generally strengthened anti-monopoly law enforcement in the field of digital economy,showing the following new trends:the legal objectives tend to be diversified,and the rule system accelerates to improve;the pertinence and strength of anti-monopoly law enforcement have been significantly enhanced;the ways and means of supervision are more flexible and diverse;establish new departments and carry out intensive research;respond to economic and social risks internally and compete for the voice of rules externally.China should strengthen the standardization,deterrence and coordination of antitrust,and further strengthen the fundamental position of competition policy.At the same time,we should actively promote the effective implementation of the amendment to the Anti-Monopoly Law,improve supporting rules and attach importance to international coordination.We should continue to improve the identification ability and relief efficiency of monopoly behaviors,and optimize prior supervision and temporary measures;encourage co-governance,sharing and technology empowerment,and strengthen compliance governance;further enrich the anti-monopoly law enforcement force and explore the optimization of relevant institutional settings.
