摘要
金融科技化为中国与东盟之间的经贸往来和金融业发展带来新的契机,也给中国和东盟的金融安全带来新的挑战。金融科技特有的隐蔽性和跨界性等特征增加了金融监管难度,容易产生监管空白和监管套利,加剧金融科技化的风险。因此,在金融安全视角下如何进一步深化中国与东盟的金融科技监管合作,成为亟待探讨的问题。当前,中国—东盟金融科技合作存在一些不容忽视的监管问题,如金融科技安全生态不完善、安全监管法律法规滞后及安全监管合作阻碍重重等。因此,结合非传统安全下的金融安全理论,提高金融科技全生命周期的安全监管技术水平,加强立法合作,增强法律的前瞻性、预见性,加强金融监管制度对接和政策沟通,对进一步实现中国周边国家金融科技低风险性和高透明化、保障“一带一路”倡议安全高效实施具有重要的现实意义。
FinTech has not only brought a novel opportunity to China and ASEAN in the field of the financial industry,but also given rise to new challenges to their financial security.The unique characteristics of FinTech,such as concealment and cross-border nature,increase the difficulty of financial supervision,create regulatory gaps and regulatory arbitradge,and aggravate the risks generated by FinTech.Therefore,how to further deepen the FinTech regulatory cooperation between China and ASEAN from the perspective of financial security has become an urgent issue to be addressed.At present,there are some regulatory problems that cannot be ignored in China-ASEAN FinTech cooperation,such as the imperfect FinTech security ecology,the lag of security supervision laws and regulations,and many obstacles to security supervision cooperation.Hence,drawing on the theoretical perspective of non-traditional security and financial security,it is suggested in this paper that it is of great significance to further realize the low risk and high transparency of FinTech in China’s surrounding countries and ensure the safe and efficient implementation of the Belt and Road Initiative(BRI)by improving the technical level of safety supervision in the whole life cycle of FinTech,strengthening legislative cooperation,enhancing the foresight and predictability of laws,and strengthening the connection of financial supervision systems and policy communication.
