摘要
随着法治政府与数字政府的建设,行政权力中不断注入算法技术,但目前算法行政权力缺乏科学分类,阻碍了学术研究的深入,权力配置失衡、规制不足等问题迟滞了算法行政能力建设实践。文章认为,需通过科学的类型化厘清算法注入行政权力后规训行政权力的两个维度,从实践性、规范性、有限人类理性层面论证并构建算法行政权力自我规训的机理。在规范算法权力上,算法权力的规制不是简单的技术或法律规制问题,须尊重算法自身的逻辑,即应在厘清算法行政权力的类型和遵循算法治理逻辑的基础上,打通权力通道以寻证“算法权力”的合法性,通过行政行为分级分类框架规范构建内外型算法行政权力,并建立算法制衡算法的正当程序机制。
With the building of law-based and digital government,administrative power is constantly injected with algorithm technology.At present,the lack of scientific classification of algorithmic administrative power hinders the deepening of academic research,and the problems such as unbalanced power allocation and insufficient regulation delay the practice of algorithmic administrative capacity-building.Efforts should be made to clarify the two dimensions of regulating administrative power after the algorithm is injected into administrative power through scientific typing,and demonstrate and construct the mechanism of self-regulation of algorithmic administrative power from the aspects of practicality,standardization and limited human rationality.In terms of standardizing algorithm power,the regulation of algorithm power is not a simple technical or legal regulation problem,but must respect the logic of the algorithm itself,that is,on the basis of clarifying the types of algorithmic administrative power and following the algorithmic governance logic,we should open up the power channel to find out the legitimacy of“algorithmic power”,standardize the construction of internal and external algorithmic administrative power through the hierarchical classification framework of administrative behavior,and establish a proper program mechanism for algorithmic checks and balances.
