摘要
统筹推进国内法治和涉外法治是习近平法治思想的核心要义之一,表明中国将强化不同场域法治实践的包容互鉴。中国海外投资是统筹推进国内法治和涉外法治的重要场域,关涉中国海外投资利益乃至中国整体主权、安全和发展。然而,传统全球化范式中的政治互信和经济合作两大基石同时发生震荡,各国短期内达成有强制约束力“硬法”的可能性不高,以“软法”为切入口可能成为中国海外投资规制的重要手段。探究软法在投资治理中的应然价值和演进需求,以及在突出其特殊价值的基础上,透过硬法巧执行、软法强执行、软法软执行等检视中国海外投资治理中的软法实践及存在问题,借助国际投资软法的理念价值完善、软法与硬法的衔接创新、国际投资软法的双向推进、硬法规则适度强化和其他配套措施完善等方法加以应对,有利于中国在新一代国际投资规则中话语权的强化。
Coordinately advancing domestic rule of law and foreign-related rule of law is the basic logic and core essence of Xi Jinping’s Thought on Rule of Law.China’s outbound foreign direct investment(OFDI)is one of the important application scenarios to coordinately advance domestic rule of law and foreign-related rule of law,and it is not only related to the interests of China’s OFDI,but also related to China’s overall sovereignty,security and future developments.Nowadays,the imbalances of existing international investment rules and practice are encountering major changes.However,two cornerstones of the traditional globalization,political mutual-trust and economic cooperation,have oscillated at the same time,so it’s impossible to reach binding“hard laws”in international investment rules in the near future.Therefore,soft law may become the dominate methodology in China’s OFDI governance.This article starts from the contention and approaches of coordinatingly advancing domestic rule of law and foreign-related rule of law,explores the theoretical value and evolutionary demands of soft law in investment governance,and highlights the special value of strengthening soft law in China’s OFDI.Then it summarizes the current situation of soft law in China’s OFDI and existing problems from three aspects:soft enforcement of hard law,hard enforcement of soft law and soft enforcement of soft law.In conclusion,China shall take countermeasures and recommendations and put forward in following aspects:improving the concept of soft international investment law,connecting and innovating soft laws and hard laws in China’s OFDI,two-way promoting soft international investment law,moderately strengthening hard laws and regulations as well as upgrading other supplementary measures,and ultimately strengthening China’s discourse in international investment rules.
