摘要
数据要素在规制滥用市场支配地位中的重要性日渐凸显,但在《反垄断法》的市场支配地位认定条款中未显见数据要素的重要作用。相关市场界定、经营者控制销售市场或者原材料采购市场的能力考量、进入市场障碍衡量等方面欠缺数据要素考量是其在市场支配地位认定条款中被虚置的原因。在“平台、数据、算法”三维结构中起到基础作用的数据对垄断地位的作用机制具体表现为网络效应、锁定效应与跨界竞争,将数据纳入平台市场支配地位的考量势在必行。在明确以用户数量为主要内容的数据规模评定标准前提下,提升数据壁垒、数据利用综合认定的实践适用比例认定平台市场力量,弥补数据要素在认定滥用市场支配地位时的法律条文缺位。
The importance of data elements in regulating the abuse of dominant market position has become increasingly prominent, but the important role of data elements is not obvious in the provisions for identification of dominant market position in the Anti-Monopoly Law. The lack of data in defining the relevant market, consideration of the ability of business operators to control the sales market or the raw material procurement market, measurement of market entry barriers and other aspects is the reason why its status is nominal in the articles for identification of a dominant market position.Specifically, in the three-dimensional structure of "Platform, Data, and Algorithm", the mechanisms of the effect of data on monopoly position, which plays a fundamental role, include network effect,lock-in effect and cross-border competition. Therefore, it is imperative to consider data into the consideration of a platform’s market dominance.On the premise of clarifying the data scale evaluation standards mainly based on the number of users, it is imperative to improve the practical application ratio of data barriers and comprehensive identification of data utilization, identify the market power of platforms, and make up the absence of legal provisions in respect of the element of data for identifying the abuse of a dominant market position.
