摘要
医疗纠纷发生后,面对多种医疗纠纷解决途径可供选择时,选择何种途径能兼顾效率与公平,做到避免冲突、化解矛盾,能实现医患双方共赢就显得尤为重要。文章旨在通过分析安徽省某三甲医院2018年-2021年已赔付医疗纠纷案例纠纷处理三种途径(院内协商、医调委调解、法院诉讼)的占比变化趋势和赔付情况,比较解决纠纷的各种途径以及效果,并以问题为导向,建议医院积极应用非诉讼纠纷解决途径,通过提升院内协商的专业性和规范性、完善医疗纠纷人民调解机制,提高解决医疗纠纷的效率,从而创造更加和谐的医患关系。
After the occurrence of medical disputes,when faced with a variety of ways to resolve medical disputes,it is particularly important to choose which way can give consideration to efficiency and fairness,avoid conflicts,resolve conflicts,and achieve win-win between doctors and patients.The article aims to discuss the impact of different dispute resolution approaches on the hospital by analyzing the percentage change trend and compensation situation of the three ways of dispute resolution(in hospital consultation,mediation by the Medical Research Commission,and court litigation)of medical dispute cases paid by a certain grade Atertiary hospital in Anhui Province from 2018 to 2021.Comparing the various ways and effects of dispute resolution,and being problem-oriented,it is recommended that hospitals actively apply non-litigation dispute resolution methods,improve the professionalism and standardization of intra-hospital consultations,and improve the people’s mediation mechanism for medical disputes,improve the efficiency of resolving medical disputes,and create a more harmonious relationship between doctors and patients.
