摘要
我国执行不能案件退出机制尚未健全,破产程序未被充分利用,距离彻底解决执行积案的目标还有很长的路。执行程序和破产程序的衔接存在移送审查标准模糊、缺少简易衔接程序、相关费用衔接不畅等实践操作层面的现实困境。因此,应从移送的审查标准、简易衔接程序、执行费用的清偿三个方面对民事执行与破产程序衔接进行完善,从而对提高程序衔接的适用率、优化执行不能案件退出机制、改善社会对破产程序的接纳能力、维护司法公正和效率有所裨益。
The withdrawal mechanism of the case of inability to execute in China has not been improved,and the bankruptcy procedure has not been fully utilized.There is still a long way to go before the goal of completely solving the backlog of execution cases.There are practical difficulties in the connection between the execution procedure and the bankruptcy procedure,such as the vague transfer review standard,the lack of simple connection procedure,and the poor connection of related expenses.Therefore,the connection between civil execution and bankruptcy proceedings should be improved from three aspects,namely,the review standard of transfer,the simple connection procedure,and the payment of the execution costs,so as to improve the application rate of the procedure connection,optimize the withdrawal mechanism of cases that cannot be executed,improve the acceptance ability of the society to the bankruptcy proceedings,and maintain judicial justice and efficiency.
