摘要
宋代御史监察制度具有体系化、法治化的特征,六察制度与互察制度是其重要组成部分。六察制度扩张了御史的监察权力及范围、优化了责任分工;互察制度则通过其他国家机构对监察权进行监督,实现权力之间的制衡,宋代还形成了科学的选官制度扩大人才储备。我国推进监察体制改革的过程中要以史为鉴,提高监察官准入门槛,将政治能力、专业能力与实践经历作为遴选的重要参考,正确界定监察官的权力范围与本质属性,促使监察工作人员合理、合法用权并承担相应的行政责任和刑事责任。此外,需重视监察机关设权与控权平衡,充分发挥同体监督与异体监督作用的同时也应尊重其独立地位,推动我国监察制度与反腐败工作的完善。
The censor supervision system in the Song Dynasty has the characteristics of systematization and legalization.The in⁃vestigating censor system and the mutual inspection system are important components.The investigating censor system expanded the supervisory power and scope of the censor,optimized the division of responsibilities.The mutual inspection system supervised the supervisory power through other state agencies to achieve balances between powers.The Song Dynasty also formed a reason⁃able official selection system to expand talent pool.In the process of promoting the reform of the supervisory system in our country,we must learn from history,raise the threshold for supervisors,take political ability,professional ability and practical experience as important references for selection,correctly define the scope of power and essential attributes of supervisors,in order to promote supervisory staff to use their power reasonably and lawfully and bear the corresponding administrative and criminal responsibili⁃ties.In addition,it is necessary to pay attention to the balance between the establishment and control of supervisory agency,give full play to the role of homogeneous supervision and heterogeneous supervision,and respect their independent status,so as to pro⁃mote the improvement of supervisory system and anti-corruption work in our country.
