摘要
退役运动员再就业面临较大的制度瓶颈,其根源很大程度在于缺少充分说明给予退役运动员制度优待的理论根据。理论上证成特定退役运动员符合就业困难人员的劳动法地位,就找到了给予退役运动员就业优待的理论根据并成为进行相应制度设计的逻辑起点。落实新修订《体育法》第46、47条之规定,在法律上明确满足特定条件的退役运动员之就业困难人员地位,就能让这些退役运动员较为顺利地对接劳动法中明确的各种制度保障和政策优惠,并在现有制度范围内保障适格退役运动员的劳动法权益。
